Personal Data Privacy Policy

This Personal Data Privacy Policy (hereinafter referred to as the 'Privacy Policy') is a public Agreement entered into between Probody Portal FZCO, the owner of the online platform https://pro-body.ae (Seller), and the Buyer. It applies to the information containing the personal data of Buyers that the online platform may obtain about Buyers while using the Online Platform's website.

1. Definitions

1.1 Personal Data – Information relating to an identified or identifiable subject of personal data, recorded on electronic, paper, and/or other physical media.

1.2. Non-Personal Data – Information automatically transmitted during the Buyer's browsing of advertising blocks and visiting pages where a statistical script system is installed, including the requested page address, cookie information, IP address, browser information, referrer (address of the previous page), and access time.

1.3. Collection of Personal Data – Actions aimed at obtaining personal data.

1.4. Processing of Personal Data – Actions directed at accumulating, storing, modifying, supplementing, using, distributing, anonymizing, blocking, and destroying personal data.

1.5. Protection of Personal Data – A set of measures, including legal, organizational, and technical, carried out for purposes established by the UAE Law 'On Personal Data Protection.'

1.6. Online Platform – The website accessible at https://pro-body.ae.

1.7. Online Services – All services available for use on the website https://pro-body.ae and its subdomains.

1.8. Buyer – A user of the Online Platform.

1.9. Seller – The owner of the Online Platform https://pro-body.ae.

1.10. Cookies – Small text files that a browser writes with data from sites visited by Buyers. Cookies perform various functions, such as allowing Buyers to navigate efficiently between pages by remembering their preferences, thus improving the website interaction experience. They can also help ensure that advertisements seen by the Buyer online are more relevant to their interests. Without cookies, it would be impossible to purchase items on the Online Platform, as the entire shopping cart functionality relies on data stored in these files. For example, if a Buyer selects a product/service on the Online Platform, adds it to their cart, and navigates to a new page, that item would not be saved in the cart without cookies.

1.11. IP Address – A unique network address of a node in a computer network using the IP protocol, which can determine the Buyer's location. The Online Platform only tracks general locations, such as city and region.

2. Subject of the Privacy Policy

2.1. This Privacy Policy establishes the Seller's obligations regarding non-disclosure and ensuring the confidentiality protection of personal data that the Buyer provides at the Seller's request when registering on the Online Platform's website and/or placing an order for goods.

2.2. Personal data permitted for processing under this Privacy Policy is provided by the Buyer through registration on the Online Platform's website and includes the following information:

2.2.1. Buyer's surname, first name, patronymic (patronymic optional);

2.2.2. Buyer's contact phone number;

2.2.3. Email address;

2.2.4. Delivery address.

2.3. Any other personal information not mentioned above (purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-disclosure, except as provided in clauses 4.3.2. and 4.4. of this Privacy Policy.

3. Purposes of Collecting and Processing Buyers' Personal Data

3.1. The Seller collects, processes, and stores only the personal data necessary for providing Services and/or facilitating the Buyer's purchase of Goods/Services from the Online Platform's catalog.

3.2. The Seller uses the Buyer's personal data for the following purposes:

3.2.1. Identifying the Buyer for order placement and/or concluding a Purchase Agreement;

3.2.2. Processing and receiving payments from the Buyer;

3.2.3. Delivering goods or services to the Buyer;

3.2.4. Providing effective customer support to the Buyer;

3.2.5. Providing personalized Services to the Buyer;

3.2.6. Communicating with the Buyer, including sending notifications, requests, and information regarding the use of Services, provision of services, and processing requests and applications from the Buyer;

3.2.7. Improving Service quality, usability, and developing new Services and offerings;

3.2.8. Informing the Buyer about ongoing events and promotions;

3.2.9. Conducting statistical and other research based on non-personal data, as well as optimizing advertising messages.

3.3. The Seller is not responsible for information provided by the Buyer on the website in a publicly accessible format.

3.4. The Seller is not responsible for losses that the Buyer may incur as a result of their login and password becoming known to a third party.

4. Rights and Obligations of the Parties

4.1. The Buyer is obligated to:

4.1.1. Provide personal data information necessary for using the Online Platform;

4.1.2. Modify and supplement the provided information if incorrect data is discovered while using the Online Platform.

4.1.3. Post advertisements only for services and goods permitted by the laws of the United Arab Emirates, particularly the Emirate of Dubai.

4.1.4. Bear responsibility independently for information posted in advertisements

4.1.5. Post advertisements with information that does not contradict the Criminal Code of the United Arab Emirates.

4.1.6. Bear full responsibility independently for the services provided

4.2. The Buyer has the right to:

4.2.1. Access and edit personal data information at any time through the web interface provided within the services.

4.3. The Seller is obligated to:

4.3.1. Use the received information exclusively for the purposes specified in Section 3 of this Privacy Policy;

4.3.2. Ensure confidential information is kept secret, not disclose transmitted personal data without the Buyer's prior written permission, except for data transfer to fulfill the Buyer's order (to courier services, postal organizations, banks, etc.), as well as to authorized bodies of the United Arab Emirates in accordance with UAE legislation;

4.3.3. Take precautionary measures to protect the confidentiality of the Buyer's personal data according to the procedure commonly used to protect such information.

4.4. The Seller has the right to:

Provide access for collection and analysis of Buyers' non-personal data to third parties for statistical purposes and advertising message optimization. The use of non-personal data by third parties is governed by their own privacy policies, and the Online Platform bears no responsibility for their use.

5. Other Conditions

5.1. The Buyer's use of the Online Platform indicates their unconditional agreement with this Privacy Policy and the conditions for the Seller's processing of the Buyer's personal data.

5.2. If the Buyer disagrees with the Privacy Policy terms, they must cease using the Website and Online Platform.

5.3. This Privacy Policy applies only to the Online Platform website https://pro-body.ae and its subdomains. The Online Platform is not responsible for third-party websites that the Buyer may access through links available on the Online Platform website.

5.4. Due to the specific nature of information collection, the Seller does not verify the accuracy of personal data provided by the Buyer and does not monitor its currency. However, the Seller assumes that the Buyer provides accurate personal data and maintains this data in an up-to-date state. The Buyer bears all responsibility and possible consequences for providing inaccurate or outdated personal data.

5.5. The Buyer agrees not to post advertisements for services of a sexual nature.

5.6. The Seller, represented by the owner and administration of the Probody Portal platform, is not responsible for information posted in advertisements and services provided by the Buyer.

5.7. The term "Body massage" used on the website refers exclusively to the provision of body massage, including only classical types of massage.

5.8. Disabling Cookies may result in inability to access parts of the Online Platform website that require authorization.

5.9. The Online Platform collects statistics about IP addresses of its Buyers. This information is used to identify and resolve technical issues and to monitor the legality of financial transactions.

5.10. This Privacy Policy and relations between the Buyer and Seller are governed by the current legislation of the United Arab Emirates.

5.11. The Seller reserves the right to unilaterally modify this Privacy Policy to further improve the security system in accordance with current UAE legislation.
